Pro-active Promotion Key for Achieving Planning Success

With the Coalition Governments ‘Big Society’ Localism Bill achieving Royal Assent in November 2011, a revolution of the planning system is likely to be around the corner, particularly in England. This is in addition to the recently introduced Local Development Framework procedure. Many Local Authorities have yet to implement the new Local Development Plans (LDP) which has evolved from this process.

David Powell, of Powells Chartered Surveyors, explains that the Localism Act is designed to give greater powers to local Government and Communities in planning decisions and the allocation of housing at a local level. The Act sets out a radical reform of the planning system in favour of a shift of power to Local Authorities and Parish Councils to have greater decision making powers on housing and development allocations.

David also adds that the introduction of the Localism Act may lead to new opportunities for landowners to contribute to the provision of sustainable development, especially rural affordable housing, due to greater flexibility in the planning system.

With a number of Local Authorities at various stages of the Local Development Framework process, it is essential not to miss critical consultation windows for the submission of representations. Monmouthshire County Council has just undertaken its consultation on the Deposit version of the new Local Development Plan and Alternative Sites Consultation. David has undertaken written representations for a number of clients for sites which are provisionally allocated for adoption into the new LDP.

In addition to the development promotion process, landowners should also seek professional advice on the best method of taking allocated sites through the planning process. There are various methods available for this in addition to funding any planning application yourself, including option or promotional agreements with developers.
